(If not, ERR not apply)<\/p>\n<p>Is it intended to replace prior agreements?<\/p>\n<p>(2) Is it a<strong> complete<\/strong> expression?<\/p>\n<p>Is it intended to replace contemporaneous agreements that are within the<\/p>\n<p>\u201cscope\u201d of this agreement<\/p>\n<p>If not integrated, no ERR<\/p>\n<p>If integrated:<\/p>\n<p>(2) <strong>For what purpose is the evidence to be admitted?<\/strong><\/p>\n<p>(a) inadmissible if it is evidence of a prior agreement or a contemporaneous agreement within the scope of this agreement<\/p>\n<p>(b) inadmissible to \u201calter\u201d or \u201ccontradict\u201d the writing<\/p>\n<p><strong>Whether something is an integration is a question of law.\u00a0 What may the judge consider? <\/strong><\/p>\n<p>(1) \u201c4 corners\u201d approach &#8211;\u00a0 only the document itself<\/p>\n<p>(2) Modified classical \u2013 evidence of surrounding circumstances admissible<\/p>\n<p>(3) UCC \u2013 Trade Usage, course of Performance, Course of Dealing always admissible<\/p>\n<p><strong>For what purposes is extrinsic evidence admissible?<\/strong><\/p>\n<p>(1) To show a defect in formation (Finger 2)<\/p>\n<p>(2) To interpret an \u201cambiguous:\u201d provision.\u00a0 In most states, whether a term is ambiguous is a question of law. \u00a0That question is usually decided using the same three approaches used to determine if a contract is integrated.\u00a0 Some courts allow the evidence to be admitted solely for the purpose of determining whether the contract is ambiguous.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Extrinsic Evidence Rule Extrinsic Evidence Rule A rule instructing you how to introduce evidence of what was promised or why the contract can&#8217;t be enforced. 20contractssyllabus31 ___ (1) Is the K integrated with respect to the term to which the extrinsic evidence applies?
